Terms of Service

You must be at least 13 years old to use WordHeat.

If you are under 18, you must have permission from a parent or legal guardian to use the App and agree to these Terms.

WordHeat is not intended for children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will take steps to delete it.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device solely for your personal, non-commercial entertainment purposes.

WordHeat is an entertainment game only. It does not involve real-money gambling or opportunities to win real-world prizes.

You agree not to:

• Reverse-engineer, decompile, disassemble, or attempt to derive source code from the App
• Modify, adapt, translate, or create derivative works based on the App
• Use any robot, spider, scraper, or automated means to access the App
• Use cheating software, bots, hacks, mods, or any unauthorized third-party software
• Use VPNs, proxies, emulators, automation tools, or network manipulation to alter gameplay
• Exploit bugs, glitches, or errors for unfair advantage
• Interfere with or disrupt servers, networks, or gameplay
• Circumvent security features or access restrictions
• Use the App for any unlawful purpose or in violation of any applicable law
• Remove, obscure, or alter any copyright, trademark, or proprietary rights notices

We reserve the right to suspend, terminate, or restrict access to your account or the App at any time, with or without notice, for any reason, including violation of these Terms.

WordHeat allows optional account creation through third-party authentication providers (Apple, Google) or email. Guest accounts are also available.

Your Responsibilities:

• Maintain the confidentiality of your account credentials
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized access or security breach
• Provide accurate and current information

We reserve the right to:

• Refuse or cancel account creation for any reason
• Suspend or terminate accounts that violate these Terms
• Suspend or terminate accounts to comply with legal obligations
• Suspend or terminate accounts to prevent fraud, abuse, or harm
• Delete inactive accounts after a reasonable period

Account termination may result in loss of access to your account, gameplay data, virtual items, and any associated benefits or purchases.

WordHeat may offer virtual items, currency, or features for purchase, including:

• Hint credits
• Energy or gameplay resources
• Premium features or subscriptions
• Cosmetic items or customization options

Important Terms:

• Virtual items have no monetary value and cannot be exchanged for real currency
• You do not "own" virtual items; you receive a limited, revocable, non-transferable license to use them
• All virtual items are part of a limited, revocable license and do not represent any stored value
• Virtual items may be modified, rebalanced, or removed at any time without notice or liability
• All purchases are final and non-refundable except as required by law or platform policy (Apple App Store, Google Play)
• Prices and availability of virtual items are subject to change without notice
• Virtual items cannot be transferred, sold, or traded outside the App

Subscriptions (if applicable):

• If future subscription features are added, they will renew automatically unless canceled at least 24 hours before the renewal date
• You may manage and cancel subscriptions through your Apple App Store or Google Play account settings
• Canceling a subscription stops future renewals but does not provide a refund for the current billing period

No Refunds for:

• Used or consumed virtual items
• Lost progress due to device issues, reinstallation, or user error
• Account termination resulting from Terms violations
• Dissatisfaction with gameplay or virtual item utility

Refund requests should be directed to the applicable platform (Apple App Store or Google Play). Platform refund policies govern any refunds. We do not process refunds directly.

WordHeat may display advertisements, including:

• Banner ads
• Interstitial ads (full-screen ads between gameplay)
• Rewarded video ads (watch ads to earn in-game rewards)

By using the App, you acknowledge and agree that:

• Third-party ad networks (e.g., Google AdMob) may collect device identifiers and usage data
• Rewarded ads grant in-game items only after successful ad completion
• Ad availability, frequency, and rewards may vary and are not guaranteed
• We are not responsible for the content of third-party advertisements
• Clicking on ads may redirect you to third-party websites or apps subject to their own terms and policies

If the App allows usernames, avatars, chat, or other user-generated content, you agree not to submit, transmit, or display content that:

• Is offensive, abusive, harassing, threatening, or discriminatory
• Contains nudity, sexual content, or violence
• Promotes illegal activity, drugs, weapons, or self-harm
• Infringes intellectual property rights or violates privacy
• Impersonates others or misrepresents affiliation
• Contains malware, viruses, or harmful code
• Is spam, advertising, or commercial solicitation

We reserve the right to remove content, suspend accounts, or take other action at our sole discretion without notice or liability.

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio, video, software, code, and game design, are owned by WordHeat or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

You may not:

• Copy, reproduce, distribute, or publicly display App content
• Create derivative works based on the App
• Use the "WordHeat" name, logo, or branding without written permission
• Extract, scrape, or reuse any portion of the App or its content
• Resell, rent, lease, or sublicense the App

Any feedback, suggestions, or ideas you provide regarding the App become our property, and we may use them without restriction or compensation.

We reserve the right, at any time and without notice or liability, to:

• Modify, update, or discontinue any aspect of the App
• Change gameplay mechanics, features, or virtual items
• Adjust pricing, rewards, or in-app purchase offerings
• Suspend or terminate servers, multiplayer features, or online services
• Require software updates to continue using the App

We are not obligated to maintain compatibility with older devices, operating systems, or App versions. Continued access to the App may require updates or newer hardware.

Service Availability: We do not guarantee uninterrupted service and may experience outages, maintenance downtime, or data loss. We are not liable for service interruptions or temporary unavailability.

In the event of discontinuation, we will provide reasonable notice where feasible, but are not liable for any losses resulting from discontinuation.

User Data Responsibility: You are responsible for maintaining backups of your own device data. We are not liable for game progress lost due to device issues, uninstalling, or corrupted storage.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Defects will be corrected
• The App or servers are free of viruses or harmful components
• Results or information obtained through the App will be accurate or reliable
• Multiplayer or online features will always be available

Your use of the App is at your sole risk. Some jurisdictions do not allow disclaimer of implied warranties, so portions of this section may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORDHEAT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or goodwill
• Business interruption or lost opportunities
• Device damage or data corruption
• Loss of gameplay progress, virtual items, or account access
• Costs of substitute goods or services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE APP EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (B) $10 USD.

Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so this limitation may not apply to you.

You agree to indemnify, defend, and hold harmless WordHeat and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any content you submit or transmit through the App

WordHeat integrates with third-party services, including:

• Authentication providers (Apple Sign-In, Google Sign-In)
• Backend and database services (Supabase)
• Advertising networks (Google AdMob)
• Analytics and crash reporting tools
• Payment processors (Apple App Store, Google Play)

Your use of these third-party services is governed by their respective terms and privacy policies. We are not responsible for the practices, content, or services of third parties.

You may request deletion of your account and associated data by:

• Using the in-app delete option (if available), or
• Contacting us at support@eloiseai.net

Account deletion is permanent and irreversible. Upon deletion, you will lose access to your account, gameplay data, virtual items, purchases, and all associated benefits.

We may retain certain information as required by law or for legitimate business purposes, including fraud prevention, dispute resolution, and enforcing these Terms. For more information, see our Privacy Policy.

Applicability: This section applies only to users located in the United States. If you reside in a jurisdiction that does not permit mandatory arbitration or class action waivers (including the European Union), these provisions do not apply to you, and disputes shall be resolved in accordance with applicable local law.

Informal Resolution: Before filing a claim, you agree to contact us at support@eloiseai.net and attempt to resolve the dispute informally. We will attempt to resolve the dispute through good-faith negotiation.

Binding Arbitration: If informal resolution fails, any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except as modified by these Terms. Arbitration shall be conducted in California, USA, or remotely by mutual agreement.

Class Action Waiver: You agree that disputes will be resolved on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative action.

Exceptions: Either party may seek injunctive or equitable relief in court for intellectual property infringement or unauthorized use of the App.

These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict-of-law principles.

To the extent arbitration does not apply, you agree to submit to the exclusive jurisdiction of the state and federal courts located in California for resolution of any disputes.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WordHeat regarding the App and supersede all prior or contemporaneous agreements, communications, and proposals (whether oral, written, or electronic).

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page and may notify you through the App or by other reasonable means.

Material changes will be effective upon posting or as otherwise specified. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.
